In these cases, interested parties can also elect to submit their case to the civil law or administrative law court, or use the arbitration rules in an approved code of conduct. If the Dutch DPA has ended the mediation, the case can still be submitted to the court. The court may still decide to request the advice of the Dutch DPA.
Handling of complaints
Pursuant to Article 60 of the Wet bescherming persoonsgegevens, the Dutch DPA may institute an investigation into the compliance with the provisions of or pursuant to the law. To this end, the Dutch DPA has the necessary investigative powers pursuant to the Wbp and the Algemene wet bestuursrecht (General Administrative Law Act).
Admissibility
Each time complaints and requests for mediation are received they are evaluated to see whether they comply with the statutory requirements and whether there is sufficient reason to accept the complaint or request.
